Terms of Service

These Terms of Service (“Terms”) are the agreement between you and AbstraScapes LLC, a Florida limited liability company doing business as H2Oasis Pools & Patios (“H2Oasis,” “we,” “us,” or “our”). They cover both the use of this website and the pool, patio, and exterior cleaning services we perform at your property.

By using this site, requesting an estimate, or letting us begin work at your property, you agree to these Terms. If you don’t agree with something here, call us at (407) 946-1854 before we start — we’d much rather sort it out up front than after the fact.

1. Our Services

We provide residential and commercial pool and exterior care in Central Florida, including:

  • Weekly Pool Service — recurring cleaning and water chemistry maintenance.
  • Pool Water Restoration (Green-to-Clean) — one-time recovery of neglected or algae-filled water.
  • Pool Equipment Maintenance — inspection, cleaning, adjustment, and minor service of pumps, filters, and related equipment.
  • Pressure Washing — driveways, walkways, pool decks, patios, and exterior surfaces.
  • Commercial Pressure Washing — storefronts, HOA common areas, offices, and similar properties.
  • Screen Enclosure Cleaning — pool cage and screen washing.
  • Other services described in a written estimate you accept from us.

Service area. Weekly pool service and water restoration are limited to our route in Minneola and bordering North Clermont. Our other services are available throughout our Central Florida service area. If you’re outside the route, we’ll tell you before you commit to anything.

What we don’t do. We do not perform work that Florida requires a state-certified or registered contractor to perform — including pool construction and structural repair, re-plastering, major re-plumbing, gas line work, and electrical work. We do not perform mold remediation, biohazard cleanup, or roof repair. If your job needs any of that, we’ll tell you and point you toward someone who can do it properly.

2. Estimates and Pricing

Every price we give is an estimate for your specific property. We don’t publish a price list or charge standard flat rates, because no two pools, decks, or driveways are the same. What a job costs depends on size, condition, access, and what we find when we look at it — so we look at it first, then quote it. Any price you see advertised as a starting point is exactly that, not a quote.

Estimates for cleaning, washing, restoration, and recurring pool service are free, and are based on the condition of your property as we observe it at the time. An estimate is good for 30 days unless it says otherwise.

Repairs work differently, and there’s one fee you should know about. A repair can’t be quoted from the driveway — diagnosing a pump, filter, heater, timer, or automation problem means opening equipment up and testing it. The diagnosis is real work, so it isn’t a free estimate.

Here’s the deal we’ll make with you. If we come out for a repair and you go ahead with the work, the diagnosis is part of the job and there is no separate fee for it. If we come out, diagnose the problem, and you decide not to have us do the repair, a $75 diagnostic fee covers the trip and the time. That’s the only fixed price anywhere in our business — everything else is quoted from an estimate. Parts and repair work are quoted separately once we know what’s wrong, and we never start on them without your approval.

If the actual conditions turn out to be materially different from what the estimate was based on — a pool in worse shape than described, surfaces that need a second pass, obstructed access, an area larger than measured — we’ll stop and talk to you before doing extra work. We will not add charges to your bill that you haven’t approved.

For recurring service, we may adjust your rate with at least 30 days’ notice. If you don’t want to continue at the new rate, you can cancel under Section 8.

3. Scheduling and Access

We schedule by service day, not by appointment time. Weather, equipment problems, and the job in front of yours all move the clock, so we give you a day rather than an hour. If a job needs you present, we’ll arrange a window in advance.

To do our work, we need you to:

  • Provide reliable access — unlocked gates, working gate codes, or a key arrangement you’re comfortable with.
  • Secure pets. We will not enter a yard with a loose dog, and we won’t count that as our delay.
  • Clear the work area of furniture, toys, vehicles, and anything fragile you don’t want moved.
  • Provide access to working water and electricity for pressure washing and exterior work, unless we’ve agreed otherwise in writing.
  • Tell us about anything we couldn’t reasonably see — a leak, a failing pump, a soft spot in the deck, a screen that’s already torn, irrigation lines, low-voltage wiring, or a surface that was cleaned improperly in the past.

If we arrive and can’t get in or can’t work because of one of the above, we’ll try to reach you. If we can’t complete the visit, the visit still counts as delivered for recurring service, and we’ll get one-time work back on the schedule as soon as you can give us access.

4. Weekly Pool Service

What’s included

A standard weekly visit covers skimming the surface, brushing walls and steps, vacuuming as needed, emptying skimmer and pump baskets, testing and balancing water chemistry with standard chemicals, checking equipment operation, and a visual look at the pool and equipment pad. We service roughly four visits per month regardless of the exact number of weeks in that month.

What’s not included

Unless your estimate says otherwise, the following are billed separately: draining and refilling, acid washing, filter cartridge cleaning or replacement, DE and sand media changes, salt cell cleaning or replacement, replacement parts and equipment, specialty or heavy chemical treatments during an algae bloom, phosphate or metal treatments, tile calcium removal, storm and heavy-debris cleanups, and anything beyond routine maintenance.

What we need from you

Water quality is a partnership, and we’re honest about the part we can’t control. Between visits, you need to:

  • Keep the water level at roughly the middle of the skimmer. A pool that runs low will damage the pump, and that’s not something we can prevent from a weekly visit.
  • Run the pump long enough to circulate the water — generally at least 8 hours a day in spring and summer, 6 in fall and winter, or whatever we recommend for your specific equipment.
  • Keep equipment in working order. If a pump, filter, or timer fails, we can’t hold the chemistry, and we’ll tell you what needs fixing.

If the water level drops, the pump doesn’t run, or equipment fails, we can’t guarantee clarity or chemistry, and any resulting extra treatment is billed separately. Heavy rain, storms, pollen season, heavy bather load, and nearby construction can all change water conditions between visits — that’s Florida, not a service failure.

5. Water Restoration (Green-to-Clean)

Restoration pricing is based on the visible condition of the water and the equipment at the time of the estimate. Recovery timelines are estimates, not promises — the pool decides how long it takes.

You should know going in:

  • Some pools can’t be chemically recovered and need to be drained and cleaned instead. If yours turns out to be one, we’ll price that separately before doing it.
  • Filters often need multiple cleanings, and cartridges sometimes need replacing, during a restoration.
  • Staining and discoloration may be permanent. Algae that has sat on a plaster or pebble surface can leave marks that no chemical will remove. Restoration clears the water; it does not resurface the pool.
  • A pool with a structural crack, a plumbing leak, or failed equipment cannot hold a restoration. We’ll identify it if we see it, but we can’t correct it.
  • Draining a pool in Florida carries a real risk of the shell shifting or “popping” from groundwater pressure. If a drain is necessary, we’ll explain the risk first, and you decide.

6. Pressure Washing, Screens, and Exterior Work

We choose the pressure and method for the surface — including low-pressure soft washing where high pressure would cause damage. Cleaning gets a surface as clean as that surface can get. It does not make an old surface new.

You agree that we’re not responsible for damage arising from conditions that already existed, including:

  • Oxidized, chalky, faded, or failing paint, stain, or sealer.
  • Loose or deteriorated mortar, grout, caulk, or stucco.
  • Rotted, soft, or previously damaged wood.
  • Brittle, sun-degraded, or already-torn screen material and worn spline. Older screens sometimes tear when cleaned even with correct technique — if a panel looks marginal, we’ll flag it before we touch it.
  • Failed window and door seals, damaged flashing, or gaps that let water in. Please close all windows and doors before we start; we’re not responsible for water intrusion through defective or open openings.
  • Loose siding, trim, screens, light fixtures, or shingles.
  • Damage from someone else’s earlier improper cleaning.

Some things simply don’t come out: rust, artillery fungus, battery acid, deep oil and transmission stains, tire marks, efflorescence, paint overspray, and etching from prior acid washing. Concrete cleans unevenly where it’s been patched or where the aggregate is exposed. We’ll tell you honestly what we expect to achieve before we quote it.

We take reasonable care to protect plants, wet down landscaping, and control runoff, but we can’t guarantee that no plant will react to the process. Mildew, algae, and mold return in the Florida climate — a cleaning is not a warranty against regrowth.

7. Equipment Service, Chemicals, and Safety

When we service equipment, we diagnose and maintain what’s there. As noted in Section 2, a repair diagnosis isn’t a free estimate: it’s free if you go ahead with the repair, and carries a diagnostic fee if you don’t. Aging equipment sometimes fails during or shortly after routine service — a seal that was already at the end of its life, a motor that was already failing. Normal service isn’t the cause of that, and we aren’t responsible for the end of an old part’s service life. Where a manufacturer’s warranty applies to a part we install, that warranty passes through to you and we’ll help you use it.

We use commercial pool and cleaning chemicals. For your safety:

  • Stay out of the pool for at least 30 minutes after a routine chemical treatment, and up to 24 hours after a shock treatment, algaecide, or restoration treatment. We’ll leave a note or message you when a longer wait applies.
  • Keep children and pets away from the work area and from any equipment or chemical containers while we’re on site.
  • Don’t let anyone swim in water we’ve told you isn’t ready.

We may pause or stop work for unsafe conditions — an aggressive animal, a wasp or hornet nest, exposed wiring, an unstable surface, a biohazard, or severe weather — without that being a breach of these Terms. Lightning stops us immediately, every time.

8. Payment, Cancellation, and Refunds

Recurring pool service

Recurring service is billed monthly, in advance, at the start of each service month, at the rate quoted in your estimate — there’s no standard published rate. That amount covers the month’s scheduled visits regardless of whether a given month has four or five service days.

One-time jobs

One-time work — restoration, pressure washing, screen cleaning, equipment service — is due on completion unless your written estimate sets different terms. Larger jobs may require a deposit, which will be stated in the estimate.

Late and returned payments

Balances unpaid after 15 days may accrue a late charge of 1.5% per month (18% per year) or the maximum allowed by Florida law, whichever is less. That’s a charge on an overdue balance, not a fee for service. If a payment is returned or fails, you’re responsible for whatever the bank charges us for it. We may suspend service on an account that’s past due, and we’ll tell you before we do. If we have to use a collection agency or attorney, you’re responsible for the reasonable costs of collection.

Cancelling recurring service

You can cancel any time. Let us know by phone, text, or email. Cancellation takes effect at the end of the month you’ve already paid for, and we’ll keep servicing your pool through that period. We don’t prorate or refund a partial month, and there’s no cancellation fee, penalty, or contract term. We may also cancel service with 30 days’ notice, or immediately if conditions at the property are unsafe or an account is significantly past due.

Rescheduling one-time work

Please give us at least 24 hours’ notice to reschedule a scheduled one-time job. There’s no cancellation charge — we just ask that you tell us, because a locked gate costs us the slot and the customer who could have had it.

Your three-day right to cancel

If you sign up for service at your home rather than at a place of business, Florida’s Home Solicitation Sale law (sections 501.021–501.055, Florida Statutes) gives you the right to cancel that agreement until midnight of the third business day after the day you sign it. Cancel by giving us written notice — in person, by mail to the address in Section 15, or by email to info@h2oas.is. A mailed notice counts as of its postmark, and it doesn’t have to be on any particular form; anything in writing that says you don’t want the service is enough. We won’t keep any part of a down payment, and this right applies regardless of anything else in these Terms.

9. Our Work — Making It Right

We stand behind what we do. If something about a completed job isn’t right, tell us within 7 days and we’ll come back and address it at no charge. That’s a workmanship commitment, and it’s the remedy we offer.

It isn’t a guarantee of a particular outcome. We can’t warrant that every stain will lift, that algae or mildew won’t return, that an old surface will look new, or that water chemistry will hold when equipment isn’t running or the water level isn’t maintained. Where those limits apply, we’ve spelled them out in the sections above.

10. Photos, Reviews, and Service Data

Documenting our work is part of how we do it — before-and-after photos, equipment notes, and water chemistry readings. By using our services, you agree to the following, and please read it carefully, because it’s a little broader than a typical service agreement.

What you’re agreeing to

You grant us a perpetual, worldwide, royalty-free right to use the following for our own marketing, advertising, website, social media, printed material, training, and to develop and improve our services and the software tools we build:

  • Photos and video of the work — the pool, deck, patio, screen enclosure, driveway, equipment, and surfaces we service, before, during, and after.
  • Reviews and testimonials you give us, including reviews you post publicly on Google or elsewhere, and any comments you share with us in writing or by text.
  • Service and pool data — water chemistry readings, chemical usage, pool size and surface type, equipment makes and models, service history, job duration, surface measurements, and similar operational information.

What we will never do

This permission is about the work, not about you. We will not publish, sell, or share:

  • Your full name, street address, phone number, or email address.
  • Any image that identifies your home — house numbers, mailboxes, street signs, vehicle tags, or recognizable faces are cropped, framed out, or blurred.
  • Your service data tied to you personally. Pool and job data is used in aggregate or stripped of anything identifying, and it is never sold to anyone.

Where you’ve already posted a public review, we may republish it as it appears publicly — typically a first name and city. If you’d like a testimonial credited differently, or credited to your business name for commercial work, just tell us. Anything more than that — your full name, your address, your face, or a photo that identifies your property — requires your separate written permission, every time.

Opting out

You can opt out at any time by writing to info@h2oas.is. We’ll stop using your photos, review, and data in new material, and we’ll remove existing uses where it’s reasonably practicable. We can’t recall material that’s already been printed, distributed, or published by a third party, and we can’t remove a review from a platform you posted it on — that’s yours to edit or delete.

11. Property, Damage, and Liability

We carry general liability insurance and we work carefully. If we damage something, tell us within 3 days of the visit so we can inspect it while the cause is still clear, and we’ll make it right.

We’re not responsible for:

  • Pre-existing damage or conditions, including everything listed in Sections 4 through 7.
  • Normal wear, aging, and the ordinary end of a component’s service life.
  • Damage caused by conditions you knew about and didn’t disclose.
  • Weather, storms, floods, lightning, falling limbs, wildlife, and other acts of nature.
  • Work performed by anyone else, before or after us.
  • Items left in the work area that you were asked to move.

To the fullest extent Florida law allows, our total liability for any claim relating to our services is limited to the amount you paid us for the specific service that gave rise to the claim, and we are not liable for indirect, incidental, or consequential damages — lost time, lost use of the pool, lost income, or similar. Nothing here limits liability for gross negligence, willful misconduct, or anything that can’t be limited by law.

You agree to indemnify us against claims arising from your failure to secure pets, disclose known hazards, or keep people out of water we’ve told you isn’t ready.

12. Using This Website

The content on this site — text, photos, logos, layout, and the H2Oasis and AbstraScapes names and marks — belongs to us or is used with permission. You may read it, share it, and link to it. You may not copy it for a competing business, scrape it in bulk, or present it as your own.

Our blog posts, FAQ, and guides are general information for Central Florida pool and patio owners, not a professional diagnosis of your specific property. Photos and illustrations may be representative rather than photos of your particular job. Prices, availability, and service areas shown on the site can change.

We aim to keep the site accurate and available, but we don’t promise it will be error-free or uninterrupted. Links to other sites are for convenience; we don’t control them and aren’t responsible for their content.

13. Calls, Texts, and Email

When you give us your phone number, you agree we may call or text you about your estimate, scheduling, and service. Message and data rates may apply, and message frequency varies. Reply STOP to any text to opt out of texts, or HELP for help. Full details are in our Text Message Terms. You can unsubscribe from marketing email at any time; we’ll still send messages about work in progress on your account.

14. General

Governing law and venue. These Terms are governed by Florida law. Any dispute will be brought in the state courts located in Lake County, Florida, and both of us consent to that venue. Small claims court is available for smaller amounts, and honestly, a phone call is available before either of those. In any legal action, the prevailing party may recover its reasonable attorney’s fees and costs.

Changes. We may update these Terms. We’ll change the “Last updated” date, and material changes to recurring service terms take effect with at least 30 days’ notice. Continuing to use our services after that means you accept the updated Terms.

Entire agreement. These Terms, along with your written estimate, are the whole agreement between us. If a written estimate conflicts with these Terms, the estimate controls for that job.

Severability and waiver. If any part of these Terms is found unenforceable, the rest stays in effect. If we don’t enforce something right away, we haven’t given up the right to enforce it later.

Assignment. You may not transfer your service agreement without our consent. We may assign these Terms in connection with a sale or reorganization of the business.
